1. Acceptance of Terms

By accessing or using Rankd ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Rankd ("we," "us," or "our"). Rankd is a proprietary software-as-a-service platform owned and operated by Rankd.

2. Description of Service

Rankd is an AI-powered job application intelligence platform that provides:

Job listing parsing and analysis
Resume comparison and scoring
AI-generated cover letter creation
Interview preparation assistance
Application tracking and management
Rate-limited access for free tier users
Premium features for paid subscribers

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts

3.1 Account Creation

To use the Service, you must:

Be at least 16 years of age
Provide accurate, complete, and current information
Maintain the security of your password
Notify us immediately of unauthorized access
Be responsible for all activities under your account

3.2 Account Types

Rankd offers two user tiers:

Free Tier: 10 job applications per 10-day fixed window
Premium Tier: Unlimited applications and advanced features

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for:

Violation of these Terms
Fraudulent or illegal activity
Abuse of rate limits or free tier restrictions
Inactivity for 12+ months

4. Subscription and Payment

4.1 Premium Subscriptions

Premium tier access is available through paid subscription. By subscribing, you agree to:

Pay all applicable fees in a timely manner
Provide accurate billing information
Maintain active payment method for recurring subscriptions
Understand that fees are non-refundable except as required by law

4.2 Fee Changes

We reserve the right to modify Premium subscription fees with 30 days prior notice. Existing subscribers will be grandfathered at their current rate for 60 days.

4.3 Free Trial

If we offer a free trial for Premium, it converts to a paid subscription automatically unless cancelled before trial ends.

5. Acceptable Use Policy

You agree NOT to use the Service to:

Apply to jobs you're not qualified for or interested in
Submit false, misleading, or fraudulent job applications
Upload resumes that are not your own
Use the Service for any illegal or unauthorized purpose
Circumvent rate limits or access restrictions
Share your account credentials with others
Reverse-engineer or attempt to extract our AI models
Use automated scripts to abuse the Service
Interfere with or disrupt the Service or servers
Impersonate Rankd or any other person or entity

6. Intellectual Property

6.1 Rankd Ownership

The Service and all original content, features, and functionality are owned by Rankd and protected by international copyright, trademark, and other intellectual property laws.

You may NOT:

Copy, modify, or distribute our software or code
Use our trademarks without written permission
Scrape or extract data from our Service
Create derivative works based on our Service

6.2 Your Content

You retain ownership of content you provide (resumes, applications, etc.). You grant us a license to use your content solely to:

Provide the Service to you
Process your resumes and job descriptions through AI
Store and back up your data
Improve our AI models (aggregated, anonymized data only)

6.3 AI-Generated Content

Cover letters, interview prep, and other AI-generated content are licensed to you for personal use in your job search. You may modify and use this content as you see fit.

7. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

8. Disclaimers and Warranties

8.1 "AS IS" Service

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

8.2 No Guarantees

We do NOT guarantee:

That the Service will be uninterrupted, timely, secure, or error-free
That AI analysis will result in job offers
That match scores or likelihood assessments are accurate
That job information is current or accurate
That cover letters will lead to interviews

8.3 Job Application Outcomes

Rankd provides analysis and recommendations only. We do NOT guarantee:

That you will be hired for any position
That our recommended resume is the best choice
That employers will view or consider your applications

9. Limitation of Liability

To the maximum extent permitted by applicable law:

9.1 Damages Exclusion

Rankd shall NOT be liable for:

Indirect, incidental, special, consequential, or punitive damages
Lost profits, lost opportunities, or lost wages
Job application rejections or missed opportunities
Data loss or corruption
Service interruptions or outages

9.2 Cap on Liability

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Rankd from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party right
Any job applications you submit through our Service

11. Third-Party Services

11.1 AI Providers

Rankd uses third-party AI providers (OpenRouter, Z.AI). These providers have their own terms and privacy policies, which govern their use of your data.

11.2 Job Boards

We are not affiliated with Seek, LinkedIn, Indeed, or any job boards. Accessing job listings through our Service doesn't imply any endorsement or partnership.

11.3 OAuth Providers

Google and GitHub login are subject to their respective terms of service and privacy policies.

12. Termination

12.1 By You

You may terminate your account at any time by:

Contacting support@tryrankd.com
Using the account deletion feature in Settings

Upon termination, all your data will be permanently deleted within 30 days.

12.2 By Rankd

We may terminate or suspend your account immediately for:

Breach of these Terms
Abuse of the Service
Fraudulent activity
Extended inactivity (12+ months)

Premium subscribers may receive a prorated refund for unused subscription time.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Australia. Any disputes will be resolved in accordance with Australian law.

13.2 Arbitration

Any dispute arising from these Terms will be resolved through binding arbitration, except where prohibited by law. Arbitration will be conducted in English under the rules of the Australian Centre for International Commercial Arbitration.

13.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and Rankd regarding the Service. They supersede all prior agreements, communications, and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms or your rights without our written consent. We may freely assign our rights and obligations.

14.5 Force Majeure

Rankd is not liable for delays or failures caused by events beyond our reasonable control, including acts of God, war, or natural disasters.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service.

Email to registered users
In-app notification
Posting on our website

Continued use after changes constitutes acceptance of the new Terms.
